1. Introduction

Welcome to polls.co.ke (“the Platform”). The Platform is owned and operated by DataScience LTD, a company incorporated in Kenya (“DataScience”, “we”, “us”, or “our”).

polls.co.ke is a digital data collection and polling platform that enables registered users (“Respondents”, “you”, or “your”) to participate in surveys, polls, and research studies conducted by DataScience LTD and/or third-party partners and pollsters (“Pollsters”).

By accessing, registering on, or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions (“Terms”).

If you do not agree to these Terms, you MUST not use the Platform.

2. Legal Framework

These Terms are governed by and interpreted in accordance with:

• The Constitution of Kenya (2010)
• The Data Protection Act, 2019
• Applicable regulations and guidelines issued by the Office of the Data Protection Commissioner (ODPC)

3. Eligibility

To use the Platform, you must:

• Be 18 years or older
• Have the legal capacity to consent to the collection and use of your personal data
• Provide accurate and truthful information during registration

We reserve the right to suspend or terminate accounts that provide false, misleading, or incomplete information.

4. Nature of the Platform

polls.co.ke operates as:

• A data collection and respondent panel platform
• A service that matches registered respondents with surveys and polls based on demographic and socio-economic characteristics
• A platform that may provide data dividends or incentives in exchange for participation, time, and data

Participation in polls is voluntary, and incentives are not guaranteed for every survey.

By registering on the Platform, you:

• Provide explicit, informed, and voluntary consent for the collection and processing of your personal data
• Consent to being contacted for survey participation
• Acknowledge that consent may be withdrawn at any time

Withdrawal of consent may limit or terminate your ability to use the Platform.

7. Data Controller and Data Processor Roles

• DataScience LTD acts as a Data Controller for data collected directly through polls.co.ke.
• In some engagements, DataScience LTD may act as a Data Processor on behalf of third-party Pollsters.
• Where third parties are involved, appropriate data processing agreements are in place.

DataScience LTD remains committed to ensuring lawful, fair, and transparent processing at all times.

8. Data Sharing and Disclosure

We may share your data:

• With Pollsters, strictly for research and polling purposes
• In anonymised or aggregated form wherever possible
• With service providers who support Platform operations (under confidentiality obligations)
• Where required by law or regulatory authorities

We do not sell identifiable personal data without lawful basis and explicit consent.

9. Data Dividends and Incentives

• Participation in some polls may attract financial or non-financial incentives
• Incentives are determined by survey scope, duration, and funding availability
• DataScience LTD reserves the right to modify, delay, or discontinue incentive schemes
• Abuse, fraud, or manipulation may result in forfeiture of incentives

Incentives do not constitute employment or contractual wages.

10. User Rights

In accordance with the Data Protection Act, you have the right to:

• Access your personal data
• Correct inaccurate or outdated data
• Object to processing
• Request deletion of your data
• Restrict processing
• Withdraw consent
• Lodge a complaint with the ODPC

• Use the Platform for unlawful purposes

Violation may result in suspension or termination.

13. Suspension and Termination

DataScience LTD may suspend or terminate access:

• For breach of these Terms
• For regulatory or legal compliance
• To protect Platform integrity

Termination does not affect lawful data processing conducted prior.

14. Limitation of Liability

To the extent permitted by law:

• DataScience LTD is not liable for indirect, incidental, or consequential losses
• Participation in surveys is at your own discretion
• No guarantee is made regarding frequency or availability of polls

15. Amendments

We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of revised Terms.

16. Governing Law

These Terms are governed by the laws of the Republic of Kenya.
